What Are the Penalties, Interest, and Fees Related to Georgia Tax Amendments?
The state of Georgia has penalties for late filing, late payment, frivolous return, negligent underpayment, fraudulent underpayment, and a failure to file an estimated tax penalty.
The penalty for filing late is 5% per month, but will not exceed a total of 25% of the tax due.
The penalty for late payment is 0.5% per month, but will not exceed a total of 25% of the tax due. Also, the late filing and late payment penalties can't exceed 25% when combined.
The penalty for frivolous return is $1,000. A frivolous return is defined by the Georgia Department of Taxation as one that doesn't have the necessary information to calculate the tax due or one with information that reflects a significantly incorrect tax, and the return was determined to be done with the motivation to hinder Georgia Tax Laws or is based on a frivolous position. The penalty for negligent underpayment is 5% of the tax underpayment. The penalty for fraudulent underpayment is 50% of the tax underpayment.
The penalty for failing to file an estimated tax penalty is 9% per year for the timeframe of underpayment.
The interest is 1% per month and is accrued from the due date until the tax is paid in full. Note that filing a tax extension or an installment payment plan doesn't exclude the taxpayer from interest or a late payment penalty.
