a. Single - filing status: Use this status if you were never married, if you are legally separated on Dec. 31 of 2009, or if you were widowed before Jan. 1 of 2009 and have not remarried in 2009.
b. Married Filing Jointly - filing status: Use this status if you are married on Dec. 31 of 2009 (whether living together with your spouse or separately), if your spouse died in 2009 and you have not remarried, or if your spouse dies in 2010 before filing a tax return for 2009.
c. Nonresident Aliens: If you qualified as a nonresident alien at any point in 2009, you can only use the 1040EZ if your status is married filing jointly. Otherwise, you must use Form 1040NR or 1040NR-EZ to file your return.
1. Your taxable income must be under $100,000.
2. Your income may only come from: wages and salaries, tips, unemployment payments, educational scholarships and fellowship grants, interest of up to $1,500, or Alaska Permanent Fund dividends.
3. You cannot claim any dependents.
4. You cannot itemize deductions.
5. You cannot claim additional standard deductions (such as those for property tax or new car tax).
6. You cannot claim credits other than the Earned Income Credit and the Making Work Pay Credit.
7. You cannot take any Advance Earned Income Credit payments.
8. You (and your spouse if filing jointly) must be younger than 65 and not blind.
9. You cannot owe any Household Employment taxes.
10. You cannot be involved as a debtor in a Chapter 11 bankruptcy filing.
